Looking for a Southwest Detention Center Defense Lawyer or Bail & Jail Release Attorney? Contact Us Today

At the Law Office of Stephen R. Brodsky, we want to help those who have been placed in the Southwest Detention Center following arrest to understand how bail and release work. As experienced Riverside criminal defense attorneys, we know that no one wants to be incarcerated, and that when you are, your first priority is to get released. For more than two decades, we have worked to protect the legal rights and freedom of clients arrested for all types of criminal offenses; we also assist with bail/release issues in order to shorten the length of time spent in jail as much as possible.

What is the Southwest Detention Center?

Located next door to the Temecula Police Department/Southwest Sheriff's Station, the detention center:

  • Houses defendants who have been convicted and sentenced to incarceration and
  • Houses arrestees temporarily until either they:
    1. Are released after posting bail or on their own recognizance
    2. Appear for their arraignment

Unless an inmate is released on their own recognizance or bail is waived following a hearing, bail must be posted for an inmate to be released. How does this work at the Southwest Detention Center.

First of all, the amount of the bail is determined by the crime that the inmate has been arrested for. Bail is a way that the court and the arresting agency can be assured that the accused will appear on court dates as expected. When a defendant is released on bail, the defendant forfeits the bail money if he/she fails to attend all court appearances. However, if all court appearances are attended, the money is returned to the defendant at the end of the case.

Southwest Detention Center bail can be posted using one of three methods:

  1. Cash bail
  2. Cashier's checks
  3. Bail bonds

With cash or cashier's checks, the full bail amount must be posted. Because the majority of inmates or their families do not have the funds to post full bail, most choose bail bonds, which usually require that you pay about 10% of the total bond. This is not refundable, and is the bail agent’s fee for getting you released from the Southwest Detention Center; however, if you do not make all of your court appearances, you are held liable for paying the bail bondsman the entire bail amount.

How can a Riverside criminal defense lawyer help with Southwest Detention Center bail and release of an inmate?

After contacting a bail bondsman, it is recommended that you consult with an experienced attorney. Defendants who are represented by a private lawyer sometimes qualify to be released from the detention center on bail of 8%.

Additionally, when the amount of the bail is high, an attorney can determine if a bail reduction hearing is warranted, and if so he/she will work to have the bail amount reduced. An experienced Riverside criminal defense attorney may also be able to get the defendant released on his own recognizance, also known as O.R. release.

If you have a family member or loved one who has been incarcerated in the Southwest Detention Center and are concerned about jail bail/release, contact the Law Office of Stephen R. Brodsky today. Our top priority is to protect the rights and freedom of our clients; we will work to determine how to reduce bail, or have it waived when possible so that your loved one can be released.
